FMCSA issues policy update regarding use of GPS (global positioning system) data in compliance reviews or other regulatory enforcement actions
As of December 19th, 2008, any motor carrier that uses any advanced technology (such as Qualcomm or other GPS tracking services) as part of its business operations is now required to retain the data generated for a full six-month period and must show it to an auditor or other regulatory investigator if it is requested. Here is an excerpt from an FMCSA Memorandum sent December 24th, 2008 to its Field Operations administrators:
“If a company uses GPS, FMCSA has the authority to request the records, and use them during the normal course of an investigation. The FMCSA considers GPS records as supporting documents, as they record the time, date and location of vehicles and drivers.”

While there are many things that can be done with the GPS data, the new report will, at a minimum compare the GPS data with the actual driver log to substantiate a driving status that shows enough driving time to cover the distance traveled since the previous ping, or a comparison to an event that should have occurred on line 4 “on-duty, not-driving”. Of course, other reports will be available depending on how and how often we receive the GPS data. With these reports you will be able to take appropriate action to ensure that your drivers are completing their records accurately.
